QTPIE COM, LLC respects the intellectual property rights of others and expects users of the Service to do the same. This policy describes how to submit a takedown notice under the Digital Millennium Copyright Act (17 U.S.C. § 512), how to submit a counter-notification, and our repeat-infringer policy.

How to Submit a Takedown Notice

To submit a notice of claimed infringement under 17 U.S.C. § 512(c)(3), email [email protected] with the subject line “DMCA Takedown Notice.” Your notice must include all six required elements:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate the material (e.g., the URL or file location).
  4. Your contact information, including your address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notice:Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

How to Submit a Counter-Notification

If your content was removed or disabled and you believe the removal was a mistake or misidentification, you may submit a counter- notification under 17 U.S.C. § 512(g)(3). Email [email protected] with the subject line “DMCA Counter-Notification.” Your counter-notification must include all five required elements:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which QTPIE COM, LLC may be found.
  5. A statement that you will accept service of process from the person who provided the original DMCA takedown notice or an agent of that person.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and restore the removed content within 10–14 business days unless the complainant files a court action seeking a restraining order against you.

Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), QTPIE COM, LLC will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers. We maintain internal records of takedown notices received and counter-notifications filed, and we reserve the right to determine, in our reasonable discretion, what constitutes repeat infringement.
