Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs how you may use the QtPie.com Service. It is incorporated into our Terms of Service. Capitalized terms have the meanings given in the Terms of Service.

The Spirit of This Policy

QtPie exists to let you create stylized gaming avatars of yourself. Almost everything that stays true to that purpose is welcome. This AUP exists to prevent the Service from being used to harm others, violate anyone's rights, or create liability for our community. We have tried to write clear, specific rules rather than vague catch-alls.

Content You Are Prohibited From Creating

2.1 Non-Consensual Images of Others

Avatars or images of any real person other than yourself without their documented, explicit, written consent. This includes celebrities, public figures, influencers, private individuals, and fictional characters modeled on real people.

2.2 Sexually Explicit or Adult Content

Content that is pornographic, sexually explicit, or graphically sexual. This prohibition is absolute — there are no exceptions.

2.3 Content Involving Minors

Any sexual, suggestive, or exploitative content involving minors. Any content that could constitute or facilitate child sexual abuse material (CSAM). Any avatar or image that depicts a person who appears to be under 18 in a sexualized context. Violations will be reported immediately to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement.

Two separate age rules:Users must be at least 16 years old to create an account (consistent with GDPR Article 8). Regardless of the user's own age, uploading or generating avatars that depict real minors (any person under 18 years old) is strictly prohibited. The 16+ account minimum and the 18+ subject minimum are independent requirements — meeting the first does not exempt you from the second.

2.4 Deepfakes and Deceptive Content

AI-generated content that realistically depicts a real, identifiable person doing or saying something they did not do or say, where the purpose is to deceive. This includes political deepfakes, defamatory content about individuals, content designed to harass a specific person, and synthetic media that could constitute fraud. Stylized gaming avatars in anime, pixel art, or other art styles are generally not “deepfakes” — this prohibition targets realistic impersonation.

2.5 Hate Speech and Discriminatory Content

Content that promotes, glorifies, or incites hatred or violence against individuals or groups based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or other protected characteristics.

2.6 Graphic Violence and Gore

Content depicting graphic violence, gore, or extreme physical harm in a gratuitous or glorifying manner.

2.7 Dangerous or Illegal Content

Content that facilitates, promotes, or depicts illegal activity, including content facilitating fraud, scams, or financial crimes, and content promoting terrorism or extremist violence.

Prohibited Conduct

3.1 Identity Impersonation

Creating avatars or content intended to impersonate another specific person to deceive others, whether for fraud, harassment, or any other purpose.

3.2 Unauthorized Third-Party Photos

Uploading photographs of other people without their consent, regardless of whether those photographs are publicly available online.

3.3 Platform Abuse

Creating multiple accounts to circumvent bans, credit limits, or other restrictions; sharing, selling, or transferring credits or account access; using automated tools, bots, or scripts to access the Service without our written permission; engaging in excessive requests designed to degrade Service performance for others.

3.4 Reverse Engineering

Attempting to extract, reverse engineer, copy, or replicate the underlying AI models, prompts, algorithms, or any proprietary aspect of the Service.

3.5 Security Violations

Attempting to compromise the security, integrity, or availability of the Service, including through hacking, denial of service attacks, or unauthorized access attempts.

3.6 Circumvention

Attempting to bypass, disable, or circumvent any content filtering, safety systems, or technical measures we use to enforce this AUP.

Content Standards for Avatars You Share Publicly

When sharing avatars publicly on social media, gaming platforms, or elsewhere, you remain responsible for ensuring your use complies with this AUP and applicable platform rules. Do not represent AI-generated avatars as photographs of yourself in contexts where authenticity matters. Disclose that your avatar is AI-generated when required by applicable platform rules or laws in your jurisdiction.

Reporting Violations

If you encounter content on our platform that violates this AUP, our Terms of Service, or applicable law, please report it to:

Include a description of the content, its location on our platform, and the reason you believe it violates our policies. DMCA copyright claims should be sent to [email protected] per the procedure in our Terms of Service.

Enforcement

We take a graduated approach to enforcement, proportional to the severity of the violation:

Level 1 — Warning: Content removal and written notice for minor or first-time violations.

Level 2 — Suspension: Temporary account suspension for repeated or moderately serious violations.

Level 3 — Termination: Immediate permanent account termination for serious violations, including any violation of Section 2.3 (content involving minors), creation of non-consensual intimate images, or activity that creates legal liability for QtPie or harm to others. Terminated accounts are not eligible for refunds of any remaining credits.

Level 4 — Law Enforcement Referral: For content that constitutes CSAM, credible threats of violence, or other criminal activity, we will refer the matter to law enforcement in addition to terminating the account.

We reserve the right to determine, in our sole discretion, whether conduct violates this AUP. Our decisions are final.
